Issues Pertaining to Rape

The cases of rape in the United State have been on the rise, according to reports from the National Intimate Partner and Sexual Violence Survey (NIPSV) from the Center for Disease Control and Prevention. According to the report, 1 in every 5 women in America is believed to be a victim of rape, and the alarming news about this is that majority of these cases involve the perpetrator was someone the victim knew. When people hear the word “rape” they think it is a stranger forcing or threatening a woman into submission, but this is not exactly accurate. Rape is a crime that is defined as the forcing of sexual relations with a person against that person’s will. The essential elements in rape are penetration, force or threats, and lack of consent.

It is the element of lack of consent that date rape has become a known form of sexual assault. Date rape occurs between two people who know each other or are acquainted with each other. Rape is an act of aggression and violence, and any sexual contact forced against the victims will is considered rape. A person who refuses, or was not given the chance to refuse (verbal refusals, physical resistance, denials or pleas) and was sexually assaulted can file charges of rape against the perpetrator.

It is common for date rape cases to involve the use of alcohol and drugs. Date rape drugs such as ketamine, GHB, and rohypnol are mixed in drinks and given to the victim, causing the victim to feel paralyzed, with blurred visions and loss of memory. These drugs are often dangerous when mixed with alcoholic drinks, and their effects are immediate without the victim’s awareness. Not many people are aware that their drinks have been spiked with a date rape drug because the effects appear to be the same as being drunk, and victims often report of not remembering the assault.

Rape is not merely a physical assault; according to the website of the Nashville criminal defense lawyers of Horst Law, rape or any sexual assault affects the emotional and psychological state of the victim as well. Aside from the medical treatments, it helps to have therapy and counseling to help get through the various emotions and traumas that came with the assault. Women are not the only victims of rape; men can also be rape victims.

In light of this, it is also possible to be falsely accused of rape. Such accusations can tarnish a person’s reputation and damage his or her relationships and potential.
